Welcome to MoveSocial. These Terms & Conditions ("Terms") govern your use of the MoveSocial mobile application and related services. By using MoveSocial, you agree to these Terms.
1. About MoveSocial
MoveSocial is a fitness-focused social networking platform that connects people through shared fitness activities and interests. We help you find and create fitness "pods" - small groups that organize fitness activities together.
2. Acceptance of Terms
By downloading, accessing, or using MoveSocial, you agree to be bound by these Terms and our Privacy Policy. If you don't agree with any part of these Terms, you may not use our service.
3. Eligibility
To use MoveSocial, you must:
- Be at least 18 years old
- Have the legal capacity to enter into these Terms
- Not be prohibited from using the service under applicable law
- Provide accurate and complete information
- Maintain only one account
You may not use MoveSocial if you:
- Have been previously banned from our service
- Are required to register as a sex offender
- Have been convicted of certain violent crimes or felonies
- Are located in a restricted jurisdiction
4. Account Registration and Security
4.1 Account Creation
- Provide accurate, complete, and current information
- Choose a secure password
- Verify your email address or phone number
- Complete the onboarding process
4.2 Account Security
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access
- You are responsible for all activity under your account
- Enable two-factor authentication when available
4.3 Account Termination
You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms.
5. User Conduct and Community Guidelines
5.1 Acceptable Use
You agree to use MoveSocial:
- In compliance with all applicable laws
- For its intended purpose of fitness-related social networking
- In a respectful and appropriate manner
- Without infringing on others' rights
5.2 Prohibited Conduct
You may NOT:
- Post inappropriate, offensive, or illegal content
- Harass, intimidate, or harm other users
- Impersonate others or provide false information
- Use the service for commercial purposes without permission
- Attempt to access others' accounts or private information
- Upload malicious code or compromise system security
- Create multiple accounts or circumvent suspensions
- Solicit money, personal information, or engage in financial scams
- Post content that promotes dangerous activities
5.3 Content Standards
All content you post must:
- Be appropriate for a fitness and social community
- Not contain nudity, sexually explicit material, or suggestive content
- Not promote illegal drugs, violence, or dangerous activities
- Not infringe on copyrights or other intellectual property rights
- Not contain spam, advertising, or promotional material
- Be your own original content or properly licensed
6. Pod Creation and Management
6.1 Pod Guidelines
When creating or managing pods:
- Ensure activities are safe and legal
- Clearly describe pod requirements and expectations
- Respect member privacy and boundaries
- Follow all applicable local laws and regulations
- Obtain necessary permits or permissions for activities
Pod creators are solely responsible for the activities they host. MoveSocial does not vet or endorse any pod, and participation is at your own discretion. Pod leaders must follow all applicable laws and ensure that their activities meet community standards.
6.2 Pod Participation
When joining pods:
- Follow pod rules and guidelines
- Respect other members and pod creators
- Participate in good faith
- Understand that activities are at your own risk
6.3 Liability for Pod Activities
- MoveSocial is not responsible for activities organized through pods
- Participants engage in activities at their own risk
- Pod creators and participants are responsible for their own safety
- Users should verify the safety and legality of activities
7. User Assumption of Risk
Participation in fitness activities involves inherent risks, including but not limited to injury, illness, or death. By using MoveSocial, you acknowledge and voluntarily accept these risks. MoveSocial does not organize, supervise, or monitor in-person events or activities. Users assume full responsibility for their own safety. MoveSocial is not liable for any harm or damages resulting from real-world interactions.
8. Background Checks and User Identity
MoveSocial does not conduct background checks or verify user identity beyond basic profile review. Use caution and discretion when engaging with others, whether online or in person.
9. Community Ratings
MoveSocial enables users to rate each other anonymously after scheduled activities. These ratings are used to calculate an average score that may be displayed on a user's profile. No written reviews are published. By participating in MoveSocial activities, you consent to receiving ratings. The platform may use structured feedback (e.g., predefined reasons for a rating) to identify behavior that violates our guidelines. Your average rating helps us maintain a positive and safe community. While ratings can't be changed after they're submitted, we continuously review feedback trends and take context into account. A lower rating may impact how often you're invited to join activities, but it won't limit your access to app features unless it's tied to a violation of our community guidelines.

- Fitness activities carry inherent risks
- You participate at your own risk
- Stop immediately if you experience pain or discomfort
- Seek medical attention for any health concerns
11.2 Activity Risks
You acknowledge that:
- Physical activities involve risk of injury
- You are responsible for your own safety
- You should assess your fitness level before participating
- MoveSocial is not liable for injuries during activities
- You should inform others of any medical conditions
12. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using MoveSocial, you agree to our privacy practices.
13. User Content and Intellectual Property
13.1 Your Content
- You retain ownership of content you post
- You grant MoveSocial a license to use your content to provide our services
- You are responsible for your content and its accuracy
- You may delete your content at any time
13.2 Our Content
- MoveSocial owns all intellectual property in our service
- You may not copy, modify, or distribute our content
- Our trademarks and logos are protected
- We grant you a limited license to use our service as intended
13.3 Third-Party Content
- We are not responsible for third-party content
- Report inappropriate content to us
- We may remove content that violates our guidelines
14. Promotions
MoveSocial may offer various promotional programs to encourage user engagement and reward active participation. All promotions are subject to availability, may have limited quantities or time periods, and are provided at MoveSocial's sole discretion. MoveSocial reserves the right to modify, suspend, or discontinue any promotion at any time without prior notice.
14.1 Premium Access Promotion
All users receive complimentary Premium access through December 31, 2025, at no cost and with no billing details required. Starting January 1, 2026, users may choose to subscribe to Premium or continue with the free Basic plan.
14.2 Profile Completion Bonus
Users who complete their full profile (including all required fields and photos) within 72 hours of account creation may qualify for extended Premium access through December 31, 2026. Eligibility is determined automatically based on profile completion timestamp. This offer is available for a limited time and may be discontinued at MoveSocial's discretion.
14.3 Monthly Prize Drawing
Eligible users may earn entries into a monthly drawing for a $50 gift card by completing qualifying actions each calendar month, including:
- Completing their profile for the first time
- Scheduling their first activity of the month
- Creating or joining their first pod of the month
Entries reset on the first day of each month. Users may earn a maximum of three (3) entries per month (one per qualifying action). Winners are selected randomly from all entries at the end of each month. Prize fulfillment is subject to verification of eligibility and may take up to 30 days after winner selection. MoveSocial reserves the right to substitute prizes of equal or greater value.
Gift card fulfillment requires a valid email address on file and may take up to 30 days after qualification. MoveSocial reserves the right to verify referrals and deny rewards if fraudulent activity is suspected.
14.4 Referral Program
Users may invite friends to join MoveSocial using their unique referral code. When two (2) invited friends complete their profiles, the referring user may qualify for a $10 gift card reward.
Referral eligibility requirements:
- Invitees must be new users who have not previously registered for MoveSocial
- Invitees must complete their full profile (all required fields and photos)
- Both qualifying invitees must remain active users with completed profiles at the time of reward fulfillment
- Referrals must be made through legitimate means; fraudulent referrals or artificial account creation will result in disqualification
Gift card fulfillment requires a valid email address on file and may take up to 30 days after qualification. MoveSocial reserves the right to verify referrals and deny rewards if fraudulent activity is suspected.
14.5 General Promotion Terms
- All promotions are subject to these Terms of Service
- Employees, contractors, and immediate family members of MoveSocial are not eligible for promotions unless otherwise stated
- Promotions may not be combined with other offers unless explicitly stated
- Rewards have no cash value and are non-transferable
- Users must have an active account in good standing to receive rewards
- MoveSocial reserves the right to disqualify users who violate these terms or engage in fraudulent, abusive, or inappropriate behavior
- Tax liability for any rewards is the sole responsibility of the recipient
- Promotions are void where prohibited by law
15. Disclaimers and Limitations
15.1 Service Disclaimer
MoveSocial is provided "as is" without warranties of any kind. We don't guarantee:
- Uninterrupted or error-free service
- Specific results or outcomes
- Compatibility with all devices
- Security against all threats
15.2 Limitation of Liability
To the fullest extent permitted by law:
- Our liability is limited to the amount you've paid us
- We're not liable for indirect, incidental, or consequential damages
- You use the service at your own risk
- We're not responsible for user conduct or third-party actions
16. Indemnification
You agree to defend, indemnify, and hold harmless MoveSocial from any claims, damages, or expenses arising from:
- Your use of the service
- Your content or conduct
- Your violation of these Terms
- Your violation of others' rights
17. Dispute Resolution
17.1 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of MoveSocial shall be resolved in the state or federal courts located in Florida.
17.2 Arbitration
Disputes will be resolved through binding arbitration rather than court proceedings, except for:
- Small claims court matters
- Injunctive relief requests
- Intellectual property disputes
17.3 Class Action Waiver
You waive the right to participate in class action lawsuits against MoveSocial.
18. Changes to Terms
We may update these Terms from time to time. We'll notify you of material changes through:
- In-app notifications
- Email notifications
- Updated terms posted in the app
Continued use after changes constitutes acceptance of the new Terms.
19. Additional Provisions
19.1 Severability
If any provision of these Terms is found invalid, the remaining provisions remain in effect.
19.2 Entire Agreement
These Terms and our Privacy Policy constitute the complete agreement between you and MoveSocial.
19.3 Assignment
We may assign these Terms to a successor entity. You may not assign your rights without our consent.
19.4 Waiver
Our failure to enforce any provision doesn't waive our right to enforce it later.
20. Emergency Situations
IMPORTANT: MoveSocial is not an emergency service. In case of emergency:
- Call 911 (US) or your local emergency number
- Seek immediate medical attention
- Do not rely on MoveSocial for emergency assistance
21. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use MoveSocial after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, in whole or in part, please stop using the app and the service.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, it will be interpreted to fulfill its intended purpose as closely as possible. The remaining provisions will remain in full force and effect.
23. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us to be legally valid.
